In December 2010, EDF Energy submitted applications to the Marine Management Organisation (MMO) and Department of Energy and Climate Change (DECC) to construct and operate a temporary jetty at Hinkley Point C. The temporary jetty would enable the delivery of construction materials, namely aggregates, cement, sand and cement replacement products, required for the construction of Hinkley Point C by sea rather than road. The following applications were submitted:
- An application for a Harbour Empowerment Order (HEO)| was submitted to the MMO to authorise the construction, operation and regulation of the jetty.
- Applications for Food and Environmental Protection Act (FEPA)/Marine Licences| were submitted to the MMO to carry out and dispose of material from the capital dredge of the berthing pocket and place material below Mean High Water Spring (MHWS) required for the construction of the jetty.
- A Transport and Works Act Order (TWAO)| application was submitted to DECC to compulsorily acquire land and rights in or over land required for the construction and operation of the temporary jetty.
Statutory consultation preceded submission of the applications and the MMO and DECC forwarded the responses received to EDF Energy. EDF Energy subsequently submitted an addendum to the Environmental Statement| which responded to environmental queries raised by various consultees (June 2010). At the same time, EDF Energy published Habitats Regulations (HRA) Information which was prepared to assist the MMO carry out their appropriate assessment of the applications. EDF Energy also submitted amendments to the HEO and plans and sections which narrowed the Limits of Deviation (area within which the specific works will take place).
In May 2011, the MMO informed EDF Energy of its intention to hold a conjoined public inquiry to consider the proposals. EDF Energy and all other parties intending to appear at the inquiry were required to submit a Statement of Case| including details of the case which those parties intend to put forward at the inquiry. The public inquiry is schedule to open on 15th November and will be taking place in The Exchange in Bridgwater.
